These Terms and Conditions regulate the use of the website denanunezart.com and the purchase of products offered on it.
By accessing and using this website, the user agrees to comply with these terms.
3. PRODUCTS & SERVICES
Our online shop offers custom pet portraits and original artwork.
Each portrait or artwork is created based on the photo provided by the client, or according to the artist’s style.
Since these are handmade, customised products, slight variations from the examples shown on the website may occur — this is part of the uniqueness of each piece.
4. ORDER PROCESS
Selection of the product:
The client selects the type of portrait or artwork and desired characteristics.
Photo upload (for custom portraits):
The client must provide a clear reference photo of their pet.
Payment:
Payment is made through the available payment methods on the website.
Order confirmation:
The client receives an email with the details of the order.
Delivery:
Delivery is carried out within the timeframe indicated on the product page.
5. PRICES & PAYMENT METHODS
Prices include VAT unless stated otherwise.
Accepted payment methods may include credit/debit card, bank transfer, or others depending on availability.
Payment must be completed before work on the artwork begins.
6. SHIPPING & DELIVERY TIMES
Orders are shipped via courier services.
Delivery times vary depending on the destination and will be indicated on the product page.
We are not responsible for delays caused by external factors such as strikes, weather conditions, logistics incidents, etc.
7. RETURNS & CANCELLATIONS POLICY
7.1 Right of Withdrawal
As these are personalised or unique handmade products, returns are not accepted once the creation process has begun.
7.2 Order Cancellations
The client may cancel the order within 24 hours of purchase, provided that work has not yet commenced.
7.3 Defective products or errors in the order
If the product arrives damaged or there is an objective error compared to what was requested, the client must notify us within 48 hours of delivery.
8. INTELLECTUAL PROPERTY & COPYRIGHT
8.1 Ownership of the artwork
All artwork created by Dena Núñez (including custom pet portraits, illustrations, paintings and other works) is protected under Spanish Intellectual Property Law (Royal Legislative Decree 1/1996 of April 12) and international copyright treaties.
The artist retains full copyright, even when the artwork has been commissioned by a client.
8.2 Client usage rights
The client acquires personal use rights over the purchased artwork, meaning they may:
✔ Display it at home or in a private space
✔ Share it on social media (crediting the artist is appreciated)
The client may NOT:
❌ Reproduce, copy, or resell the artwork without written permission
❌ Modify the artwork
❌ Use it commercially without prior authorisation
8.3 Artist usage rights
The artist reserves the right to:
✔ Publish images of the artwork on her website or social media as part of her portfolio
✔ Use images for promotional purposes
Unless the client expressly requests otherwise.
If the client requires full exclusivity, this must be agreed before purchase and may involve an additional cost.
8.4 Usage of digital kawaii portraits
When purchasing a kawaii digital portrait, the client receives a personal-use licence only, meaning they may:
✔ Use it as a profile picture or wallpaper
✔ Print it for personal use
✔ Share it on social media (credit appreciated)
The client may NOT:
❌ Modify, resell, or use the illustration commercially
❌ Claim copyright ownership
9. DATA PROTECTION
The processing of personal data is governed by our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR) and Spanish Law 3/2018 on Data Protection and Digital Rights.
10. GOVERNING LAW & JURISDICTION
These Terms & Conditions are governed by Spanish law.
In the event of a dispute, both parties submit to the courts of Valladolid, Spain.
If the user is a consumer within the EU, they may also use the European Online Dispute Resolution platform:

All images, portraits and visual content displayed on this website are the property of Dena Núñez Art.
Their reproduction, distribution or use without prior written consent is strictly prohibited. Legal action may be taken in case of infringement.
