This is a model contract. A personalised copy will be sent to the client for review and signature after the reservation is confirmed.

In the event of any doubt or discrepancy, the written agreement between the parties will prevail.

Custom Artwork Commission Contract

In Sardón de Duero, on the ____ day of __________ 20__.

BETWEEN

Ms. Dena Núñez, visual artist, hereinafter THE ARTIST,

and

Mr./Ms. ____________________________________, ID/Passport No. ______________________, hereinafter THE CLIENT.

Both parties recognise that they have the legal capacity to enter into this agreement and agree as follows:


RECITALS

  1. THE CLIENT wishes to commission THE ARTIST to create an original artwork (custom pet portrait or other original piece), hand-drawn using pastel or another technique previously agreed upon.

  2. THE ARTIST agrees to carry out the commission, according to the terms stated below and in line with her professional artistic criteria.

Therefore, the parties agree to the following clauses:


CLAUSES

1. Purpose of the contract

The purpose of this contract is the commission and sale of an original artwork, hand-drawn by THE ARTIST based on the photograph(s) or references supplied by THE CLIENT.


2. Artwork details

The commissioned artwork will have the following characteristics:

THE ARTIST agrees to respect these details while maintaining full creative freedom within her artistic style.


3. Price and payment terms

The total price of the artwork is:

___________ € (including VAT where applicable)

Payment will be made as follows:

50% as a non-refundable reservation fee, payable upon confirmation of the commission.
The remaining 50% must be paid BEFORE the artwork is started.

Once 100% of the total price has been paid, THE ARTIST will begin creating the artwork.

The 50% reservation fee is non-refundable, as it covers materials and the exclusive reservation of time in the artist’s schedule.


4. Completion time

The estimated completion time is _________ days / weeks from the moment the full payment is received.

This is an approximate timeframe. Reasonable delays caused by workload, shipping issues, illness, force majeure or other justified reasons shall not be considered a breach of contract.

The artwork will be securely packaged. THE CLIENT must inspect the parcel upon receipt and notify any damage within 7 calendar days, providing photographic evidence.


6. Cancellation policy

If THE CLIENT cancels the commission after paying the 50% reservation fee, this amount will not be refunded.

If cancellation occurs after 100% of the price has been paid but BEFORE the artwork has been started, THE CLIENT may request a refund of the second 50% payment only.

Once THE ARTIST has begun creating the artwork, no cancellations or refunds will be accepted, as the artwork is a personalised commission.


7. Nature of handmade artwork

THE CLIENT understands that:

✔ The artwork is unique and handmade
✔ Minor variations from examples or sketches may occur
✔ Artistic interpretation forms part of the commission

Therefore, returns or changes based on personal taste, expectations or subjective opinions are not accepted.


8. Copyright and intellectual property

Ownership of the physical artwork is transferred to THE CLIENT once full payment has been received.

However:

All copyright remains with THE ARTIST
✔ The artwork may not be reproduced, copied or used commercially without written permission
THE CLIENT receives private, personal-use rights only

THE ARTIST may publish images of the artwork on her website or social media as part of her portfolio, unless THE CLIENT expressly requests otherwise before the commission begins.

If THE CLIENT requires full image exclusivity, this must be agreed in advance and may involve an additional fee.


9. Data protection

Personal data will be processed in accordance with applicable regulations and the Privacy Policy available on the website.


10. Governing law and jurisdiction

This contract is governed by Spanish law.

For the resolution of any dispute, both parties submit to the Courts of Valladolid (Spain), unless mandatory consumer protection rules specify otherwise.
